When a DOT-regulated employee has a drug or alcohol testing violation, employers are required to:
  • Remove the employee from safety-sensitive duties immediately
  • Provide information about the SAP evaluation process and resources
  • Require completion of the SAP-recommended education or treatment
  • Obtain documentation from the SAP confirming the employee has completed follow-up evaluation and is eligible to return
  • Conduct follow-up testing as directed by the SAP (minimum of 6 unannounced tests in the first 12 months)

The RTD process is federally mandated and includes several key steps. Employers do not determine treatment—that is the role of a qualified SAP. However, employers must ensure the process is followed correctly and that all required documentation is collected before an employee resumes safety-sensitive work.

A SAP is an independent professional who evaluates employees and recommends appropriate education or treatment. Employers are not permitted to influence SAP recommendations, but employers are responsible for ensuring employees are referred to a DOT-qualified SAP.

Below are common questions employers ask when an employee has a DOT drug or alcohol testing violation.

What should we do immediately after a DOT violation?

Remove the employee from safety-sensitive functions. Provide the employee with information on the DOT Return-to-Duty (RTD) process. Refer the employee to a DOT-qualified SAP for an initial evaluation.

Can the employer choose the employee's education or treatment?

No. The SAP determines appropriate education and or treatment recommendations based on the evaluation. The employer’s role is to ensure the employee completes the process and that required documentation is maintained.

What documentation should we collect before allowing Return-to-Duty?

Employers typically need the SAP’s follow-up evaluation documentation indicating the employee has successfully complied with recommendations and is eligible to complete the RTD testing step, plus any required internal documentation aligned with company policy and DOT rules.

How many follow-up tests are required?

The SAP sets a follow-up testing plan. DOT rules require a minimum of six unannounced follow-up tests in the first 12 months. The SAP may extend the plan (up to 60 months) depending on the case.

Who is allowed to communicate with the SAP?

Communication is typically handled through the employer’s designated representative (often the DER) and must remain within DOT guidelines. Employers may not attempt to influence SAP recommendations.
