Employer FAQs
What should we do
immediately after a DOT violation?
Remove the employee from safety-sensitive functions. Provide the employee with information on the DOT Return-to-Duty (RTD) process. Refer the employee to a DOT-qualified SAP for an initial evaluation.
Can the employer choose the employee's education or treatment?
No. The SAP determines appropriate education and or treatment recommendations based on the evaluation. The employer’s role is to ensure the employee completes the process and that required documentation is maintained.
What documentation
should we collect before allowing Return-to-Duty?
Employers typically need the SAP’s follow-up evaluation documentation indicating the employee has successfully complied with recommendations and is eligible to complete the RTD testing step, plus any required internal documentation aligned with company policy and DOT rules.
How many follow-up tests
are required?
The SAP sets a follow-up testing plan. DOT rules require a minimum of six unannounced follow-up tests in the first 12 months. The SAP may extend the plan (up to 60 months) depending on the case.
Who is allowed to
communicate with the SAP?
Communication is typically handled through the employer’s designated representative (often the DER) and must remain within DOT guidelines. Employers may not attempt to influence SAP recommendations.
How can Pinnacle SAP
Services help?
Pinnacle SAP Services can help you connect employees with DOT-qualified SAP evaluations, clarify the standard RTD steps and documentation expectations, and support clear, compliant coordination between the employee, SAP, and DER.
